These Terms of Service ("Terms") govern your access to and use of the BeMorphy website personalization service (the "Service") operated by BeMorphy ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
BeMorphy provides AI-powered landing page personalization. You install a JavaScript snippet on your website, and the Service dynamically rewrites page copy based on advertising parameters (UTM tags) in the visitor's URL. The Service includes a dashboard for managing sites, viewing variants, and tracking engagement.
You must be at least 18 years old and have the legal authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

You are solely responsible for all AI-generated content displayed on your website through the Service. While we strive to produce high-quality, accurate personalizations, AI outputs may occasionally be inaccurate, inappropriate, or inconsistent with your brand voice. You should review generated variants in the dashboard and adjust settings as needed.
We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. The Service operates on a best-effort basis, and you assume all risk associated with displaying AI-generated text to your visitors.
Your content. You retain all rights to the original content on your website. By using the Service, you grant us a limited, non-exclusive license to read, process, and modify the text content of your pages solely for the purpose of providing personalization.
Generated content. AI-generated text variations produced by the Service are provided for your use on the website where they were generated. You may use generated variants freely on that website.
Our Service. All rights, title, and interest in the Service, including software, algorithms, design, and documentation, remain our exclusive property.
The Service offers free and paid plans as described on our pricing page. Paid subscriptions are billed monthly through Stripe. Prices may change with 30 days' notice.
Credit packs (extra customizations or visits) are one-time purchases, non-refundable, and expire at the end of the billing period in which they are purchased.
Subscriptions may be canceled at any time through the billing portal. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial months.
We aim to provide high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any loss or damage resulting from service interruptions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL BEMORPHY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless BeMorphy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) AI-generated content displayed on your website; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.
Either party may terminate this agreement at any time. You may delete your account from the dashboard. We may suspend or terminate your access if you violate these Terms or if we determine, in our sole discretion, that your use poses a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days, except where retention is required by law or for legitimate business purposes (e.g., payment records).
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by sending a notice to your account email. Continued use of the Service after changes constitutes acceptance. If you disagree with any changes, you should stop using the Service and delete your account.
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts of Amsterdam, the Netherlands.
These Terms constitute the entire agreement between you and BeMorphy regarding the Service. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision does not constitute a waiver. You may not assign or transfer these Terms without our consent.
